Terms and Conditions

Definitions
In this agreement:

  • "The Photographer" refers to Hannah Webster, trading as Hannah Webster Photography Limited.

  • "The Client" refers to the party hiring the services of the Photographer.

  • "Images" refers to any photographs, prints, or other physical or electronic materials provided by The Photographer.

Copyright and Ownership
The Photographer retains full ownership, copyright, and intellectual property rights over all images at all times, globally.

Right to Credit
The Photographer asserts the right to be credited as the author of their work in accordance with the Copyright, Designs and Patents Act 1988 (or its amendments). The Client agrees to credit the Photographer as "Hannah Webster Photography" whenever possible.

Use of Images

  • The Images may only be used in accordance with the agreed terms specified in the booking form.

  • Any additional use, manipulation, or alteration of the images requires prior permission from the Photographer.

Exclusivity

  • The rights to use the images are granted solely to the Client and cannot be transferred to third parties unless for purposes directly related to the Client’s work (e.g., reproduction or PR).

  • The Photographer has the right to refuse granting reproduction rights to third parties.

  • The Photographer will not sell or use the images for any monetary gain.

  • The Photographer retains the right to use the images for advertising or promotional purposes at any time, worldwide.

Client Confidentiality
The Photographer agrees to maintain confidentiality of any information or materials provided by the Client, unless disclosure is necessary to fulfill the Photographer’s obligations related to the work.

Booking

  • The Client must complete a Booking Form via email, after which the Photographer will send a confirmation email. The booking is only confirmed once this is received.

  • Once a booking is confirmed, the Photographer will reserve that time exclusively for the Client.

Cancellation or Postponement by the Client
If the Client cancels the confirmed booking:

  • Less than 7 business days before the shoot: 20% of the booked fee will be charged.

  • Less than 24 hours before the shoot: 50% of the booked fee will be charged.

  • On the day of the shoot: The full fee will be charged.

  • If the Client postpones the booking, the Photographer may charge a postponement fee at their discretion, along with any expenses incurred due to the cancellation or postponement.

Cancellation by the Photographer
If the Photographer is unable to attend due to circumstances beyond their control (e.g., illness, injury, crime), they will attempt to find an alternative photographer for the Client.

In such cases, the Photographer’s liability is limited to a full refund of any fees already paid by the Client.

Rejection of Images
Unless a rejection fee is agreed upon in advance, the Client has no right to reject the images based on style or composition after the initial proofs have been approved.

Charges and Timings

  • The agreed fee will be charged based on the quoted rate.

  • If there are changes to the brief or additional expenses arise, the Photographer reserves the right to charge extra fees.

  • If the Client requests additional time or the job exceeds the original brief, the fee will increase according to the agreed hourly rate.

  • Delays or incorrect information provided by the Client (e.g., wrong location, wrong time) will result in the full fee being charged.

  • Fees include up to 80 miles round trip. Any additional mileage is charged at £0.45 per mile.

  • Parking, road tolls, and congestion charges will be passed on to the Client as additional costs.

Payment Terms

  • Payments are due within 30 days of the invoice date unless otherwise agreed in writing.

  • The Photographer reserves the right to charge interest on overdue payments as prescribed by the Late Payment of Commercial Debts (Interest) Act 1998.

  • Unpaid invoices will become due immediately if any invoice is not paid by the due date, even if less than 28 days have passed since the invoice was issued.

  • Payments are preferred by BACS. Bank details will be provided on the invoice.

Liability and Indemnity

  • The Client is responsible for obtaining all necessary rights, releases, and consents for any third-party use of the images.

  • If the Client uses the images without obtaining the proper rights, the Client agrees to indemnify the Photographer against any claims, damages, or legal fees resulting from such use.

Archiving of Images

  • Final images will be stored and archived by the Photographer for 1 year.

  • If the Client requires access to archived images after that period, an admin fee may apply.

  • The Photographer is not liable for any lost or stolen images after 1 year of storage, but will reimburse the Client for the original cost of the images if the loss occurs within that period.

Applicable Law
This agreement is governed by the laws of England and Wales.

Variation
Any changes to these Terms and Conditions will only be valid if agreed in writing by both parties.
